Regulatory Investigations and Enforcement Course

 

Course Overview

The Regulator Enforcement Course provides comprehensive knowledge and skills for state regulators to effectively handle regulatory enforcement matters. Through this course, participants will gain a deep understanding of the legal aspects related to enforcement, including civil and criminal law, the Constitution, Separation of Powers, and the court system. We also explore the influence of European Union law and its application in regulatory contexts. As a unique aspect, the course includes a visit to the Four Courts, offering first-hand observation of regulatory prosecutions.

Participants will learn about court procedures, rules of evidence, and the powers of Authorised Officers. Emphasis is placed on the law of evidence, including admissibility, burden of proof, and preparation of a book of evidence. Practical sessions, such as interviews, witness statements, and courtroom simulations, further enhance learning and skills development.

Course content

  • Introduction to the Irish Legal System.
  • Criminal Prosecutions (including introduction to the rules of evidence) and Judicial Review
  • Sources of Law – Legislation & Precedent, with a focus on the IAA's legislation.
  • Structure of the Court – District and Circuit Court criminal procedure.
  • The Law of Evidence.
  • Disclosure and the Book of evidence.
  • Examination in Chief/Cross examination.
  • Interview skills and note taking.
  • Legal Discovery

This course is specifically designed for professionals associated with regulatory bodies, whether or not they have a legal background. It is aimed at individuals responsible for conducting investigations and prosecuting regulatory matters.
