Protected Disclosures Annual Report 2023

Annual Report of Irish Aviation Authority under the Protected Disclosures Act 2014

Section 22 of the Protected Disclosures Act 2014 requires the publication of an Annual Report relating to Protected Disclosures received.

Pursuant to this requirement, the Irish Aviation Authority (IAA) herby confirm that 9 external reports made or transmitted under sections 7, 7A, 10C and 10D of the Act in 2023, 7 were received via the external reporting channel established under section 7(2B) of the Act. 

There were no reports transmitted by another prescribed person under section 7A(1)(b)(vi) of the Act or by the Protected Disclosures Commissioner under section 10C(1)(b) of the Act. 

Of the 9 external reports, 2 reports were transmitted by the Protected Disclosures Commissioner under section 10D(1)(b)(ii) of the Act.

With respect to the assessment of reports, of the total number of reports received in 2023, 2 were awaiting completion of assessment at year end and a further 4 were assessed as warranting further follow-up. 

No reports were transmitted to another prescribed person or the Protected Disclosures Commissioner. No reports were closed because the report was clearly minor, or because it was a repetitive report containing no meaningful new information. No reports were referred to another more relevant procedure. Of the total number of reports received in 2023, 3 reports were assessed as warranting no further follow-up.

With respect to the investigation into the reports, 9 investigations were opened in 2023. No reports were carried over from the previous year. Of the total number of reports received in 2023, 4 reports were closed in 2023 and 5 remained open at the end of the calendar year. Of the number of investigations reported as open at the end of the calendar year, 2 were open less than 1 year. 

Of the investigations opened in 2023, 1 involved allegations of criminal offences, 9 involved allegations of breaches of a legal obligation, 1 alleged acts or omissions that are oppressive, discriminatory or grossly negligent or constitute gross mismanagement, and 1 involved allegations of breaches of the EU laws within the scope of Article 2 of Directive (EU) 2019/1937. No reports contained allegations of concealment or destruction of information.

Of the total number of reports received in 2023, 1 was made anonymously, resulting in an investigation being opened. The reporting person subsequently disclosed their identity in 2023.

There were no internal Reports made under section 6 of the Act.

The IAA processes reports in accordance with the internal and external reporting channels and procedures established in accordance with the Protected Disclosures Act 2014.
